Burglary and Breaking and Entering?

In my state they are essesntially the same crime. They are both described as the unlawful entry of a dwelling with the intent to commit a crime. It does not have to be theft, just any crime. Now tresping is the unlawful entry of a dwelling or property. in my mock case I have fingerprints and nothing else. The suspect has no legit alibi except he did not steal anything or break into the house. He has not really explianed his prints. My question is
